The information below pertains to the 2012 Holiday Schedule:
Additional Day of Paid Leave for Classified Employees
Under collective bargaining contract provisions, classified personnel employed on or before December 24, receive one additional day of paid leave (pro-rated for part-time employees) on the workday before or after Christmas Day, or the day before or after New Year's Day. If work requirements prevent an employee from taking one of these four days, the employee may use the day on another day prior to June 30, 2013. If the day is not taken by June 30, 2013, with supervisor authorization, it is forfeited.
To be eligible for holiday pay, classified employees must be in paid status at least one-half (1/2) of the last scheduled workday before the holiday and at least one-half (1/2) of the first scheduled workday after the holiday, provided such scheduled workdays occur within seven (7) calendar days before and after the holiday (Article 42-Section 3(G).
Additional Day of Paid Leave for Unclassified Employees (Academic, Research and Professional Faculty)
The Governor has granted academic employees an additional day of paid leave in conjunction with Thanksgiving, Christmas or New Year's Day. These eight hours of additional paid leave (pro-rated for part-time employees) are granted to 12-month, unclassified employees employed on or before December 24. This leave may be used pre-Thanksgiving, the workday before or after Christmas Day, or the workday before or after New Year’s Day. Academic employees who are unable to be away from their duties to take the additional day of paid leave in the current year are allowed to use the paid leave until June 30, 2013.
Classified Employees Working Irregular Workweeks and Application of Compensatory Time Off
It is the policy of the Oregon University System that full-time and part-time classified employees are to receive recognition for all of the above holidays. In order to provide the same number of holidays for all eligible employees, persons assigned irregular workweeks (other than Saturday and Sunday as regular days off)
should be credited with compensatory time at a straight-time rate for all holidays that fall on their regular days off.
Accounting for Time Worked on a Holiday by Classified and Unclassified Employees
Classified employees will receive compensatory time off for all holiday time earned unless an employee elects to receive cash for hours worked, calculated at a time-and-one-half rate, when they are required or allowed to work on days recognized as legal holidays. Provisions governing holiday scheduling and holiday work compensation are contained in Article 42 of the Service Employees International Union Collective Bargaining Agreement.
Academic employees (FLSA exempt and non-exempt) who are required to work on a University recognized holiday are to be compensated for hours worked at the rate of time and one-half in the form of pay or compensatory time off at the discretion of their employing unit.
Early Unit Closure Prior to the Start of a Holiday
Administrators and supervisors are responsible for providing adequate staffing coverage to maintain normal operations prior to the holiday. Please be reminded that administrators do not have the authority to close their units without approval of the President or his designee.
- Supervisors may authorize early release of classified staff as long as the employees record usage as vacation leave, personal leave, or leave without pay for the early release time taken.
- Administrators cannot provide release time to classified staff outside the provisions of the collective bargaining agreement.
- FLSA non-exempt academic employees are expected to report early leave usage to their supervisors for early release time taken.
University Operating Schedule during the December 2012 Holiday Season
As listed above, the University will be closed on Monday, December 24, 2012, as classes are not in session and there is an overall reduced workload for departments and units. All offices and university operations are to be closed statewide on December 24, 2012. Employees are not to report to work unless they have been notified by their supervisor to do so because they are on duty to perform essential services and functions. Essential services and functions are those that are critical and necessary for maintaining safe and secure university operations.
While December 24, 2012, is an observed holiday for classified employees, it is not a holiday for unclassified employees. Unclassified employees are expected to use vacation leave, compensatory time accrual, or the additional day of paid leave if granted by the Governor to cover the absence.
